Revenge in Romeo and Juliet Essay

The want for revenge leads many of the characters in Romeo and Juliet into murderous acts which eventually leads to severe punishments and a further need for revenge. The everlasting revenge in Romeo and Juliet is first born from ancient grudge between the Capulets and the Montagues, which is ultimately settled with the tragic, abrupt unifying factor of both Romeo and Juliet’s death. Several instances within the interactions of the characters suggests that vengeance is driving force of the plot, and that consequently, there must ultimately be an end to the feuding and recoil, due to the fact that there must be a resolution after the thrilling climax.. The first factor causing revenge springs from the ancient grudge between the Capulets and the Montagues, which curiously was never fully explained in the play. This ancient grudge is the initial justification that accounts for the two family’s first dispute in the streets of Verona. Two households, both alike in dignity, In fair Verona, where we lay our scene, From ancient grudge break to new mutiny, Where civil blood makes civil hands unclean. (Prologue) However, after the first civil brawl, Romeo and Mercutio decide to intrude on the Capulet’s masked party. Consequently, they eventually become discovered by Tybalt due to Romeo’s easily distinguishable voice, yet Capulet discourages and scolds him from confronting Romeo and ruining the party. This humiliates Tybalt, and draws him into wanting to take the present matters into his own hands, dealing with Romeo and Mercutio some other time while his anger gradually builds. Tybalt This, by his voice, should be a Montague. Fetch me my rapier, boy. Capulet Am I the master here, or you? go to. You’ll not endure him! God shall mend my soul!†¦ Well said, my hearts! (1.5) After the Montague’s intrusion on the masked party and the first civil brawl, the want for repercussion further increases within each character, especially Tybalt, eventually leading to the untimely death of Mercutio, with his last few breaths plotting revenge on both families. Why the devil came you between us? I was hurt under your arm†¦ Help me into some house, Benvolio, Or I shall faint. A plague o’ both your houses! They have made worms’ meat of me: I have it, And soundly too: your houses! (3.1) Mercutio does get his revenge on both families, since Romeo is soon banished after the slaying of Mercutio, Tybalt is slain, and accordingly, a series of adverse experiences occurs within the lives of both families. To seek revenge for his friend Mercutio’s death, Romeo murders Tybalt, who now is  his own kinsman. Now, Tybalt, take the villain back again, That late thou gavest me; for Mercutio’s soul Is but a little way above our heads, Staying for thine to keep him company: Either thou, or I, or both, must go with him. (3.1) After Tybalt is eradicated by Romeo, the citizens of Verona try to step in and get their own revenge for the Montague’s and Capulet’s fighting in the fair streets of Verona because they are disturbing the peace. Which way ran he that kill’d Mercutio? Tybalt, that murderer, which way ran he? (3.1) Benvolio replies to the citizens statement by announcing that Tybalt made threats and killed Mercutio first, and from that, Romeo received a newly contrived revenge. An envious thrust from Tybalt hit the life Of stout Mercutio, and then Tybalt fled; But by and by comes back to Romeo, Who had but newly entertain’d revenge, And to ‘t they go like lightning, for, ere I Could draw to part them, was stout Tybalt slain. And, as he fell, did Romeo turn and fly. This is the truth, or let Benvolio die. (3.1) Lady Capulet soon afterwards gets her revenge for Romeo killing her kinsman. She pleads to the Prince to put Romeo at fault, since he killed Tybalt, believes that Romeo is telling a lie, and also because of her ancient grudge against the Montagues. He is a kinsman to the Montague; Affection makes him false; he speaks not true: Some twenty of them fought in this black strife, And all those twenty could but kill one life. I beg for justice, which thou, prince, must give; Romeo slew Tybalt, Romeo must not live. (3.1) Because of this second quarrel, which the Prince has strictly forbidden, the Prince decides to set punishments for this pointless fighting, and decides to set forth his vengeance upon Romeo for quarreling in Verona again and disturbing the tranquility. And for that offence Immediately we do exile him hence. I have an interest in your hate’s proceeding, My blood for your rude brawls doth lie a-bleeding; But I’ll amerce you with so strong a fine That you shall all repent the loss of mine. (3.1) In response to his exile, Romeo threatens to commit suicide in Friar Lawrence’s cell. Friar Lawrence then attempts to calm Romeo down, eventually leading into a humiliating conversation for Romeo as the Friar gets his revenge for Romeo’s threats and groans about the banishment. Art thou a man? Thy form cries out thou art. Thy tears are womanish; thy wild acts denote The unreasonable fury of a beast. Unseemly woman in a seeming man. (3.3) After hearing about Romeo’s banishment, Juliet becomes distressed, and locks herself in her room. Old Capulet converses with Paris about her change in heart, and converses with him about the details of the wedding. However, once Capulet tells Juliet about the upcoming wedding, Juliet refuses to marry Paris, causing Capulet to erupt in a rage, and in revenge, cursing and threatening Juliet for not accepting the marriage to Paris. Hang thee, young baggage! disobedient wretch! I tell thee what: get thee to church o’ Thursday, Or never after look me in the face: Speak not, reply not, do not answer me; My fingers itch. Wife, we scarce thought us blest That God had lent us but this only child; But now I see this one is one too much, And that we have a curse in having her: Out on her, hilding! (3.5) This is Capulet’s revenge for Juliet’s refusal to marry Paris, and putting all the effort that he put into the wedding to waste. This incident springs into yet another reprisal. Juliet asks the once faithful nurse to help put off the wedding, however, she surprisingly suggests that Juliet marry Paris, since she considers him a more fit husband over Romeo. Juliet doesn’t want to be an unfaithful bride to Romeo, and in revenge, scorns the nurse in retaliation for her suggestion to marry Paris and unwillingness to aid her in the postponing of the wedding. Ancient damnation! O most wicked fiend! Is it more sin to wish me thus forsworn, Or to dispraise my lord with that same tongue Which she hath praised him with above compare So many thousand times? Go, counsellor; Thou and my bosom henceforth shall be twain. I’ll to the friar, to know his remedy: If all else fail, myself have power to die. (3.5) The final predominant act of revenge in Romeo and Juliet occurs in response to Juliet’s refusal to marry Paris. She fabricates death, so that she will be able to sneak to Mantua with Romeo. Her death is her revenge for  Capulet’s forcing her to marry Paris and threatening her with banishment. O, bid me leap, rather than marry Paris, From off the battlements of yonder tower; Or walk in thievish ways; or bid me lurk Where serpents are; chain me with roaring bears†¦ And I will do it without fear or doubt, To live an unstain’d wife to my sweet love. (4.3) Thus, with her death, her parents become dismayed, and won’t be able to experience the joys that they were hoping for in marriage, as expressed in the last scenes of the play. The Prince then dictates to both families about the consequences of their wearisome hate, and the extensive sequence of vengeance is finally ends, with the Prince carrying out the final act of revenge by punishing both families for the death Mercutio and all the grievances that have been endured.. Where be these enemies?-Capulet, Montague, See what a scourge is laid upon your hate, That heaven finds means to kill your joys with love, And I, for winking at your discords too, Have lost a brace of kinsmen. All are punished. (5.3) Revenge is the key to the advancement of the complex plot in Romeo and Juliet. It causes events to happen that would never have happened otherwise, and creates a suspenseful mood as well as several other themes and morals to  be incorporated into the play. However, this ageless vengeance can only be stopped by the deaths of both family’s children, and in the process of that, several others suffered the vile consequences of revenge. The definitive central idea of Romeo and Juliet characterizes how malevolence can eventually lead to drastic encounters, and that they can overshadow several other important occurrences in the lives of those affected by the discord. In Romeo and Juliet, this disarray and the portentous threats were resolved too late, and only occurred with the devastating unifying influence of the loss of each family’s child.

Hancock film Essay Hancock is a film starred by Will Smith as Hancock himself. This film separates itself from the rest of the films for it is an unconventional story of a super hero. The media has instilled in its audience that as a superhero, one must be a good role model. He should be, if not perfect at all, at least close to being one. And yet, this film is a story of the superhero who was a drunkard and undisciplined and selfish man. He seemed ordinary. It was hard to somehow believe that he can save lives. That was what was special about this film. It created a new image of a superhero. It showed a different angle on creating a good superhero. It showed that man is capable of becoming a hero, no matter how bad he can become at times. With these differences it had, it was rather right to question if the film was an effective superhero film. The location and the setting of the film were appropriate to its story. It had the view of an everyday and ordinary life of an ordinary man. Since Hancock was not to be considered as the typical superhero, it seemed that he was treated as an ordinary but strong character. His environment emphasized his strength and his goodness. His strength was presented when people around him tried to insult him. This was shown in scenes where he was called an asshole and then he made sure he was able to teach the person who called him with such name a lesson. Nonetheless, he was provided with the attitude of goodness. His environment was filled with criminals and law breakers. It showed that even if Hancock was drunkard, he wanted to make sure that he saved lives and put criminals in jails. The Mise-en-scene of the film was even so effective in aiding the story through out the duration of the film despite the weakness of the storyline. Hancock, as a superhero film, was expected to have low angle shots to show the authority of the protagonist or the superhero. However, there were a number of high angle shots in the film which suggests the authority of the audience. The shots of Hancock were always either close up shots or medium shots. This focuses the film to Hancock himself. It relayed the message to me that Hancock should be closely watched for the story centers around him and I, as an audience, am a part of his environment. With this, there seemed to be something different with the film. It is not just any typical superhero film. It is rather more emotionally attached in the part of the audience, given the high angle shots and the close up and medium shots of the character. This may be a good one, but also, it can be a bad one. Focusing on its bad effect, it lost its capacity to establish the authority and superiority of the lead character, who was supposed to be treated as an ordinary human yet a superhero. The shots were not moderately thorough which resulted to the was confusion in the shots whether he should be an ordinary lead character or the superhero. If the cinematography was good, it should have made it possible for the audience to identify the character’s role with its visual content, even without the dialogues of the film. The editing of the film was fairly clean. However, there were effects which were slightly disorienting or confusing. One example is when Hancock flew with the car of the pursued criminals. The car bumped on buildings but the buildings were broken instead of the car. One would ask the question, ‘How can that be possible? ’ Although it must aslo be considered that this film is a fiction and it should contain improbable scenes. As the audience, my reason for stating that the editing was fairly clean is because it was able to put to visual an ordinary setting. There were clean cuts of the frames. The transition from one scene to another was clear. On the other hand, there were only minimal special effects like the flying of Hancock, the breaking of the buildings, cars and roads. Other than that, there was nothing more to suggest in the editing that Hancock was a superhero film. Moving on to the musical scoring and sound effects, the film was able to have its audio presented well. The musical scoring was appropriate to the scenes where it was played. An example is when Hancock was flying and the song was Get out the Way by Ludacris. There were birds and other things that were blocking him in flying faster to where he was needed. Another example is the scene where Hancock was in jail and Ray and Mary were thinking about him. The background sound was dramatic and it showed the emotions of the character towards each other. The sound effects were in same manner as appropriate as the musical score. The crashing of the cars, the breaking of the buildings, the flying of Hancock, the cheering and booing of the crowd, the flashing of the camera of reporters, and many other sound effects were placed in the proper scenes. Even the small details were given the proper sound effects. Nothing was taken for granted when it came to the audio. The characters’ delivery of their lines was clear which suggests the usage of proper and reliable devices. The volume of the background sounds were also just enough for the audience to get the hold of both the emotion of the character and the setting of the scene. All in all, the sound of the film acted as its soul. And it is but fair that this made the film live justifiably well in its technical sense on music and sound. The most important contributor in this film was its Mise-en-scene. It was well provided and it was very effective in its purpose in identifying the film as a superhero yet, seemingly ordinary world of Hancock. It was a very good establishing point of the story. It was able to tell the story as clearly as possible. Although I must say that the story was not as strong as it should have been and the cinematography lacked a little organization. Still, the Mise-en-scene was able to provide the audience the factors and elements they it needed in order to be well-informed about the film. It provided the proper imagination for the audience to fully grasp what the scriptwriter and the director wanted to convey. The question whether Hancock was an effective superhero film or not, I must answer that it did not have the strongest justification for a yes. The visual of the scenes were good, however the shots and angles were not as good. There seemed to be something missing in the scenes. The sound in the film provided the audience well with aid to the visual but it was not quite enough. The film needed a tighter interconnection of the visual and the audio in the technical aspect so as to deliver the story well. And although the Mise-en-scene and the sounds of the film were independently provided well, it still lacked the spice to say that the film was indeed an effective superhero film.

Film Adaptation Les Miserables by Victor Hugo Essay Non-Consequentialist theories of morality are best expressed by the character Inspector Javert. His actions are lead by the theory that it is better to lead a life where rules are followed. It is your duty to obey the laws and it is your duty to always act in this manner. Consequences are not to be considered when judging a persons actions (Thiroux, Krasemann, 2012, p. 46). Inspector Javerts position in society supports his actions. This man must follow the laws set by his government, and lead his community by example. His duty was to carry out the law which are examples of rule absolutes which offer no room for exceptions (Thiroux, Krasemann, 2012, p. 87). The Inspector becomes obsessed with the capture of Jean ValJean, a criminal who must be caught and brought to justice. The film begins with the story of a man, Jean ValJean, who is first introduced to the viewer in a prison setting, where later you find out he was imprisoned for theft. After serving nine-teen years of punishment in prison for his crime he is then rewarded release on parole. Following his release he encounters another situation where he acts in contrast to those beliefs of a rule utilitarian like Javert. These contrasting characters are examples within their guiding principles. Non-Consequentialist Theories are based on the idea that consequences are not and in fact should not be a factor in determining whether the act is moral or immoral (Thiroux, Krasemann, 2012, p. 46). Where as consequentialism is based or concerned with consequences. Jean ValJeans guiding principles are more of an act utilitarian who believes that everyone should perform that act which will bring out the greatest good over bad for everyone affected by the act (Thiroux, Krasemann, 2012, p. 37). Utilitarianism is a form of Consequentialism. Javert is a rule utilitarian where his ideas are that everyone should always follow the rule or rules that will bring greater good. These ide as are contrasting because it is unsure what actions would bring greater good with or without making exceptions to the rules at hand. Javert being an official of the law encourages the importance of law within the film to avoid loosing control within his community. On one hand ValJean broke the law only to avoid the death of starvation. These situations are the basis of the conflicting approaches to morality by each main character in the film. ValJean encounters the Character of Bishop Myriel who offers him a job and teats him kindly despite his criminal background. The Bishop is a positive influence on ValJean. While working for the Bishop, he makes a promise to become a better man and redeem himself only after being caught once again for stealing silverware from the bishop. The Bishop lies to officers only to save ValJean from returning to prison. With the silver that was stolen and now a gift was he only able to accomplish his promise for a better life. ValJeans commitment led him to later became the owner of a factory and the Mayor of his city. There we are first introduced to the character of Fantine. We discover that she has a child, Cossette, who is in care with another family The Thenardiers. Fantine works hard to provide for Cossette at the factory where she is later fired from, which led to her desperate need to make money. Desperate times cause for desperate measures., like Fantine prostituting to as a mean to make money. Fantines unlawful actions lead her to encounter the Inspector Javert. Here is where the feuding theories of morality between Javert and ValJean are once brought to question once again. Should Fantines actions be justified by the idea that prostitution is wrong and unlawful, or is it okay because she must provide for Cossette and her needs? In the end the Mayors position allows Fantine to avoid prison time thus bringing about greatness for her family. His utilitarian approach to the situation causes more conflict with the Inspector who believes she should be inprisoned for breaking the law. More evidence with the personal moral theories conflicting are evident when Jean ValJean promises Fantine that he will take care of her daughter Cossette. He first must escape from Mr. Jovert who is now aware that he is a convict. Javert expressed the idea that a law breaker cannot reform therefore ValJean should not be Mayor. Javert commented on his parents also being criminals when he was a child. Once exposed ValJean escapes once again with Cossette to Paris, where they live in a convent. He feels it is his duty to carry out his promise of a better life. Reparation (prima facie) is a duty mentioned when looking at non-consequential theories (Thiroux, Krasemann, 2012, p. 54). Cossette and ValJean are able to achieve a fulfilled life with security in the city of Paris while at the convent. Cossette ultimately asks to not become a nun and persuades ValJean to live outside the convent. Willing to please Cossette, ValJean agrees to the move. Cossette attracts an admirer while exploring her new surroundings in the character Marius. Marius is a young revolutionary who asks to â€Å"Restore the Republic†. He becomes obsessed and determined to interact with Cossette, very much like he is committed to his revolution. Inspector Javert also resides in Paris where he is the newest Deputy as the reward from exposing the truth about Jean ValJean. The â€Å"cat and mouse game† between Jean ValJean and the Inspector Javert is continued in Paris when he is informed with information about the revolutionists new love interested Cossette. Marius was followed by one of ValJeans informant following the revolutionists. Javert is once again on the hot pursuit to bring ValJean to an end. He is determined to bring justice because it is the right thing for him to do. ValJean unaware of Cossettes relationship with her young suitor opens an opportunity for the Inspector to get close and finally cease the former convict. ValJean now a â€Å"reformed man† refuses to give up without a fight. In the attempt to flee once again ValJean is encountered with the dilemma of Marius and Cossettes relationship. Her relationship is troubled by the increasing resistance from the revolutionists against the Parisian army. With the city barricaded ValJean must return Marius safely to Cossette. In pursuit for Marius the army injures Cossettes love and now ValJean must flee the chaos of the city with the injured Marius. Not before once again encountering the persistant Javert. This is a turn of events that gives ValJean to turn on his predator and kill him. This doesnt happen because ValJean is said to have been merciful towards the Inspector. In the end of this tale the Inspector is surprised by the mercy ValJean showed towards him. The Inspector allowed the convict to aid the Marius to some medical attention and return to his capturer. ValJean also agreed to be turned into the Parisian officials after saving Marius. With Marius alive he would no longer have to worry about his Cossettte. Therefore fulfilling his commitment to Fantine. Upon returning Mr. Javert expressed how his guiding principles to perform his duty the right way brought him confusion when ValJean showed him mercy in the situation of life and death. Death was the only solution the Inspector had in store to this for this ending. Everything ValJean did was justified when the Inspector decided to kill himself. The Inspector never breaking the law himself saw that there were flaws to his guiding principles and could not live with himself no more. Unwilling to face the consequences he saw fit to end his life thus granting ValJean his freedom. He felt his obsession for the capture of the ValJean would see no end and haunt him forever. At this point he acknowledges the fact that ValJean is a reformed man and not an â€Å"animal† thought to have been created while in the prison system. Before ValJean was a â€Å"difficult problem† to the Inspector himself and he needed bring justice to those acts of the former Mayor. Everyday we are faced with the same if not different situations where we are asked to do the â€Å"right thing†. This is very difficult even to those who appeal to be morally or ethically correct. Rules can be to general and only act as a guide to do the greatest of good while avoiding consequences. It is also difficult in the sense that there acts or rules offer no exceptions. The story of Les Miserables proves otherwise. ValJean overcame many difficulties and while his actions may have been unlawful they did affect those around him positively. His actions in the end brought him security and loving relationship with his â€Å"daughter†, Cossette, all while ultimately keeping his promis to the Bishop Myriel and the late Fantine. His actions throughout the film prove that he is indeed a good man despite his criminal background. ValJean accomplishes reformation which seemed impossible to the characteristics of the Inspector. Ciminals should be brought to jusitice, laws are meant to be followed, under no circumstances can the law be flawed, and no exceptions are to be made. These guiding principles for the Inspector shaped his actions throughout this story. ValJeans actions show that his is a honest, caring, and loving man who is rewarded with freedom. He no longer has the fear of being caught by the Inspector and also rewarded with love from his â€Å"daughter†, Cossette. In the film ValJean states that â€Å"Love is the only future God gives us†. The guiding theories to ones ethical and moral dilemmas can be conflicting with those of others. Here we have actions based on the idea of realizing the consequences for your actions first or not thinking about any consequences and acting on what you feel to be right. Rules should always be followed with no exceptions. The belief that one should not be judged or defined by any action in particularly. Rules are important to a society bringing awareness to consequences by ones actions. It is important to not give up on ourselves because we are all capable of reformation if we want it.

Ethical Issues in Randomized Control Trials PROBLEM 1 A research team is conducting a Randomized Control Trial of a new drug to treat the common symptom of the Ebola virus (fever) over the past six (6) months. The experimental group consisted of female Ebola patients aged between 30 and 50 years to whom the new drug was administered. The control group consisted of male Ebola patients aged between 70 and 80 years. To this control group placebo, a substance that resembles medicine superficially and is believed by the patient to be medicine but that has no medicinal value was administered. Discuss ethical issues associated with this research design? Ebola virus disease also as (EVD) is a highly infectious and contaminating disease which has recently killed thousands especially in West African. This disease is a severe and most often fatal illness in humans. The Research design used Randomized Control Trial, however it does not state how it was able calculate the RCT sample size. The years in age of women and men are listed but we do not know how many participants the experiment had. This research conducted random sampling, was the randomization truly â€Å"random,† or are there really are two populations being studied here. It is very difficult to come up with two randomized age groups of men and women. As stated above Ebola is a very dangerous disease and one of the ethical issues in research is that vulnerable groups should not be used unless benefits outweigh the damages, the age group of men between 70-80yrs fall in that category as elderly. This research design would have been giving this vulnerable group a placebo m edicines (dumpy) to this group over a period of 6 months. How many individuals would have been lost to this fatal killer disease? The declaration of Helsinki states that in any medical study, every patient including those of a control group, if any should be assured of the best proven diagnostic and therapeutic method. The controlled group where not assumed of this, placebo control trials are justified when it comes to testing a new product like hair removing creams which has no permanent damage, with severe illness this cannot be acceptable .illness that are fatal and highly contagious when with a placebo control is not justifiable with Ebola because without any medical intervention they will die. The study design also shows large evidence of both allocation and performance bias, in a sense the women that were selection to the intervention group were specifically chosen to be in the intervention group, due to the fact that they will perform better, by facilitating quick and desirab le recovery compared to the elderly men whom their bodies cannot respond with the same efficiency. Lastly some of these elderly men are Husbands, Dads, Granddads, brothers of other people countless family will suffer endlessly over 6 months, whilst their relative is not getting any help at all. What modifications would you suggest on the research design in future? There is never a single way to follow when it comes to research, however they are research design which are more suitable and permit the evidence obtained to answer the initial question as explicitly as possible. In future I would use I would use Time series design. This is due to the fact that Time series design allows each participant to receive an intervention over a period of time and results are measured before and after any intervention. Hence reducing the fatality that are associated with Ebola but also making it less contagious if the medication is being effective. Another change I would introduce is to remove the placebo medication, one cannot be comparing a drug efficiency to a dumpy Placebo, and if it is a new medication then it will have to be compared to other similar drugs to assess its effectiveness instead of nothing, whilst humans are dying and others getting contaminated within that 6 months. Another change would be for the research not to use vulnerable elderly as the control group, hence using adolescent and young adult sample population, since they would give a clearer indication to the efficiency of the new drug. Lastly I would calculate a large enough sample size to increase the findings internal and external validity. Due to Ebola being fatal a sample size would help, by clarifying the total fatalities experience but most important the number of patients cured. PROBLEM 2 One of the leading causes of fast spread of HIV and AIDS in Africa is poverty particularly income poverty that forces unmarried women and girls to indulge in prostitution. In January2005, the IMF/World Bank designed a 10-year micro-finance targeting 1000 prostitutes. The aim of the project was to see a significant drop in the number of women or girls who indulge in this malpractice. To be registered as a beneficiary, interested women and girls were required submitted an application and pay a processing fee of MK500. A total of 2500 applications were received at the close of the deadline. To identify project beneficiaries, it was decided that a lottery be conducted and that all applicants be invited to witness the draw. After selecting the beneficiaries (i.e., treated group), a random draw was also conducted to select non-beneficiaries (i.e., control group). Discuss ethical issues associated with this research design? Acquired immune deficiency syndrome (AIDS). AIDS develops from infection with HIV (human immunodeficiency Virus), which attacks the immune system and disables a person’s defenses against other diseases, including infections and certain cancers. This research used Random selection to find the 1000 participants it wanted to induct into the micro-finance program .Firstly the time frame of the project, the project was meant to run for 10 years and considering that this will have been an observation study design a lot of things can happen within the 10 years, which will affect the internal Validity of the findings. Secondly this Research design asked participants to pay for the application ,a sum of K500 which would total up to K1,250,000 million for the 2500 applicants. Research ethics prohibits payments that can potentially cause pressure, bribes and economic social disadvantages. Therefore many individuals who really need the help would have been excluded, subsequently them havi ng inability to source out the K500.It is also unethical asking money from a poverty group who happens to practice prostitution, they will engage in this malpractice to raise that K500, leading to the project not trying to stop prostitution but encouraging it on the other hand. Research designs have to respect the privacy and confidentiality of participants at all times. Conducting a Lottery where everyone is invited and dividing the treatment and control groups of prostitutes in front of a congregation hampers privacy and confidentiality ethics, this sort of exposure can result into the applicants looked down upon by community members. What modifications would you suggest on the research design in future? When it comes to payments, Research ethics promotes that participants should be suitably compensated for any expenses, compensated for effort, time or lost income, and acknowledged for their contribution.in total this research raised K1,250,000 million. The suitability of this money is not justifiable since IMF bank will actually be spending huge amounts monthly to sustain this project. I would remove this application fee so that its open to every suitable candidate without having financial hinders. The applicants were unmarried women and girls, I think that the focus should have been different since these are different age groups. The women can be put on the micro-financing plan whist the girls can be given a different option to continue on with education and the money directed towards their fees. To expand on that it would be better to teach the participants to fish rather than give them fish every time for 10 years, since when the project stops they will go back and continue with their malpractices (prostitution) .However if you can teach some of the women income generating activities and education for the girls then they will be able to become dependent and stop the prostitution altogether. This is known as transformative participatory monitoring and evaluation. Another change that I would install is the time span of the projects 10 years is a lot of time, I would change the Research design to Randomized Control Trial with Crossover design. This would allow all 2500 participants to partake, thus not having any control groups, but time sequence when they would be receiving the money, hence follow ups can be conducted to what the individuals are capable of with and without benefits. Futuristic speaking, I would change the design of the selecting process of the 2 groups, a Lottery selection were everyone is invited would be cancelled and conduct an expert panel to assess economic, social and health status of the applicants. The Unsuccessful Use of Ethanol Current interest in ethanol fuel in the United States mainly lies in bio-ethanol, produced from corn, but there has been considerable debate about how useful bio-ethanol will be in replacing fossil fuels in vehicles. Concerns relate to the large amount of arable land required for crops, as well as the energy and pollution balance of the whole cycle of ethanol production. I don't think the US could implement the use of ethanol or other alternate fuels successfully as Brazil has done for many reasons: firstly, ethanol production in the United States does not benefit the nation's energy security, its agriculture, economy or the environment because ethanol production requires large fossil energy input to produce these fuels than you get out from the combustion of these products. Therefore, it is contributing to oil and natural gas imports and U.S. deficits. The country should instead focus its efforts on producing electrical energy from photovoltaic cells, wind power and burning biomass and producing fuel from hydrogen conversion. Secondly, in Brazil reducing the rate of deforestation seemed likely to be more effective for taking carbon dioxide out of the atmosphere. In the United States, reliance on ethanol to fuel the automobile fleet would require enormous, unachievable areas of corn agriculture, and the environmental impacts would outweigh its benefits, destroying bio-diversity. Ethanol would be mainly made from bio organic material that will be especially grown for this purpose. It also uses a lot of fuel to grow these plants. The same goes for various kinds of vegetable oils that are said to be environmental friendly. Ethanol cannot alleviate the United States? dependence on petroleum, may, however, still be useful in regions or cities with critical pollution problems, and to make use of agricultural wastes. Basically, an increased demand for ethanol would cause land use changes - destroying forests and grasslands to grow corn or other ethanol crops - ethanol and other bio-fuels actually add to global wa rming. Unlike many other countries, America has established a separation between church and state to give everyone the choice of what they want to do with their life. I believe an American should take advantage of what the country has to offer, benefit the country in a way you see fit, and also follow the guidelines that has been set forth by our founding fathers. America is known for their unlimited opportunities, and these opportunities were meant to be taken advantage of by the American citizens. Citizens are given many freedoms other third world countries do not even consider releasing to the public. In most cases, countries outside the United States have governments that take action on those who choose to speak freely or participate in a different religion. Freedoms such as freedom of religion, free speech, the right to assemble, etc. are all characteristics of an average American. If someone doesn't have the right to perform any of those just listed then they are obviously not an American. All of these freedoms and rights are not only allowed, but they are strongly encouraged. It is what this country fought so long and hard for. Normally, people who were not born in America come here for the labor. People of America are raised to get an education and a job, and to find some way to benefit the country. That's how America is economically and financially supported. Taxes are what keeps our country on its' feet. You are morally and legally obligated to pay these fees issued to you by the government. If you don't pay your taxes you're not supporting the country that gave you liberty and justice, and by not paying taxes your just committing a selfish act. We would not be here today if everyone in America did whatever benefited themselves. Everyone in this country puts together what they can to improve their country, we are united! Hence the name United States. Like any other country, the government is what keeps everything in place. The government is not there to make your life miserable, at least not in America.

Fair Labor Standards Act

Today we are fortunate to have laws to protect us from being forced to work excessive hours without being fairly compensated. We have laws to protect our children from being forced to work at an early age and these laws protect us from working in unsafe and unhealthy conditions. In 1938 our 32nd president Franklin D. Roosevelt was able to have the â€Å"Fair Labor Standards Act† passed and signed into law. This piece of legislation was a land mark in our history.It banned most child labor; it set a minimum hourly wage and set the standard work week. This was the beginning that made employers develop records to keep track of the wages that they paid to their employees and records of the hours the employees were working. The Supreme Court had been one of the major obstacles to wage-hour and child-labor laws. In the 1936 Presidential race wage-hour legislation was a campaign issue and Roosevelt promised to seek some constitutional way of protecting workers.When President Franklin D. Roosevelt won the 1936 election by a landslide he was determined to overcome the obstacles of the Supreme Court’s opposition as soon as possible. Roosevelt and his Secretary of Labor, Frances Perkins tried to make a model for employers of government contractors in all fields, not just construction. But the Federal Government actually encouraged employers to exploit labor because the Government had to award every contract to the lowest bidder.President Roosevelt and Frances Perkins continued to try to get congress to pass acts to prohibit the labor of children and set minimum wages and hours. The â€Å"Fair Labor Standard Act† in a draft form was sent to the White House where two trusted legal advisers of the President, and with the Supreme Court in mind, added new provisions to the already lengthy bill. Roosevelt had told his Secretary of Labor, that the length and complexity of the bill caused some of its difficulties with Congress, and asked for it to be shortene d.Lawyers tried to simplify the bill but faced the problem that, although legal language makes legislation difficult to understand, bills written in simple English are often difficult for the courts to enforce. Because the wage-hour, child-labor bill had been drafted with the Supreme Court in mind, the bill could only be cut from 40 pages to 10 pages. The bill was voted upon May 24, 1938 and after the House had passed the bill, the Senate-House Conference Committee made more changes to reconcile differences.During the legislative battles over fair labor standards, members of Congress had proposed 72 amendments. Almost every change had exemptions, narrowed coverage, lowered standards, weakened administration, limited investigation, or in some other way worked to weaken the bill. What had survived was approved by the conference committee and passed the House on June 13, 1938 and then the Senate approved it. Congress then sent the bill to the President, and on June 25, 1938, the Presid ent signed the Fair Labor Standards Act into law. This affected industries that employed about one-fifth of the US workforce.About 700,000 workers were affected by the wage increase and 13 million more were affected by the hour’s provision. It mostly affected white males, and about 14 percent of women (http://www. u-s-history. com). Children under the age of fourteen were no longer legally allowed to work with some exceptions in the agricultural industries and family businesses. Children under the age of eighteen were banned from working â€Å"hazardous† jobs in mining and some factory jobs. This had greatly reduced the number of children injured by bad working conditions.Children between the ages of 14 and 16 have had additional restrictions on the number of hours they are allowed to work to encourage them to stay in school. During a school day they are only allowed to work three hours and no more than eighteen hours in a school week. Children are not allowed to work before 7a. m. and after 7 p. m. , and from June 1 through Labor Day they are not allowed to work after 9 p. m. The 14 and 15 year old also have addition al restrictions in addition to the â€Å"hazardous† jobs that they may not perform.These jobs include the food service industry such as baking, cooking, working in the freezers and meat coolers, operating food slicers, grinders, choppers and bakery mixers. Fourteen and fifteen year olds are also not to perform jobs that require loading or unloading goods on or off of trucks, railcars or conveyors and they are not to work in connection with maintenance or repair of buildings, equipment or machines. Employers may be assessed civil monetary penalties of up to $11,000 for each employee who is the subject of a violation of the Act’s child labor provisions.A civil monetary penalty of up to $50,000 may be assessed for each child labor violation that causes the death or serious injury of any minor employee, and these assessmen ts may be doubled, up to $100,000 when the violations are determined to be willful or repeated (LindenMeyer, 2004). In the â€Å"Fair Labor Standard Act† the federal minimum wage began at 25 cents per hour in 1938 and it has had over twenty amendments made over the years for increases. The latest rate of $7. 25 per hour was effective on July 24, 2009.In addition to a minimum wage employers must pay the employee’s wages in cash or something that can easily be converted to cash or legal forms of compensation, for example food and lodging. Employers cannot pay their employees with coupons or tokens that can only be used in a store owned by the employer. Discounts that are granted to employees by the employers cannot be used towards meeting the minimum wage requirement. There are a number of employment practices which ‘Fair Labor Standard Act† does not regulate.They are vacation, holiday, severance, or sick pay; meal or rest periods, holidays off, or vacations; premium pay for weekend or holiday work; pay raises or fringe benefits; or a discharge notice, reason for discharge, or immediate payment of final wages to terminated employees. The standard work week in 1938 was reduced to 44 hours per week, and if employees were to work over that they would be paid over time at a rate of their wages plus one-half wages for the additional time worked. By 1940 the standard work week was reduced to 40 hours per week (www. dol. gov/dol/oasam/programs/history/flsa1938. htm).Despite this law in 2006 a class action law suit was brought against Wal-Mart for not paying its employees for their overtime and forcing them to work through their breaks. Wal-Mart lost the law suit and the workers won $78. 4 million (Worth 2008 p 12). In 1961 an amendment was added to the â€Å"Fair Labor Standard Act† called â€Å"enterprise coverage†. It applies to employers whose annual sales total $500,000. 00 or more, or who are engaged in interstate commerce. The courts interpreted that the term interstate commerce to cover companies that regularly use the U. S. mail to send and receive letters to and from other states.The courts included that employees that use company telephones or computers to place or accept interstate business calls or take orders would make the employers subject to the â€Å"Fair Labor Standard Act† (Steingold, 2009). There are also exemptions to the â€Å"Fair Labor Standard Act† where some employees do not qualify for the provisions of overtime or the minimum wage requirements. These employees who are not entitled to it are called â€Å"exempt† employees. Employees that are always entitled to the overtime and the minimum wage pay provisions are â€Å"nonexempt† employees and they are blue-collar employees and first responders.Blue-collar employees include carpenters, electricians, mechanics, plumbers, iron workers, craftsman, operating engineers, construction works, and laborers. First responders are workers that are on the front lines of protecting safety and health. They include police officers, firefighters, medical technicians, ambulance personnel, and hazardous materials workers. Employees that are always exempt and are never entitled to overtime or a minimum wage are employees of seasonal amusement or recreational businesses, employees of newspapers with a circulation of less than 4,000 and newspaper deliver people, and workers of small farms.Some employees are exempt if they meet certain requirements; this is usually because the employees are being paid a salary that compensates them enough for the extra duties and responsibilities that they have. Executive, administrative and professional workers are exempt if they meet the specific guidelines. The requirements for an exempt executive worker are that they must manage other workers as a primary job duty and have at least two full time employees that they are in charge of. They must have the ability to hire , fire, discipline, promote, and demote others or make recommendations about these decisions.The executive worker must earn a salary of at least $455 per week. The requirements for an administrative employee to qualify as exempt are that they must primarily complete their work directly for the business’s management or administration. They must be independent workers and primarily use their own discretion and judgment on their work duties. The administrative employee also must earn a salary of at least $455 per week. The requirements for an exempt professional are that they complete work that requires invention, imagination, originality, or talents in the arts such as music, writing and acting.They may need to be a highly intellectual and have been trained in extensive studies such as law, medicine, theology, accounting, engineering, architecture, teaching, and pharmacy. The must also earn a salary of at least $455 per week. Outside sales people are exempt if they regularly wo rk away from the employers’ office and make sales or obtain orders or contracts for services or facilities. Exempt salespersons are generally paid through commissions and will require little to no supervision to complete their job.The exemption from the minimum wage and overtime pay provisions also applies to computer specialist that receives a salary of at least no less than $455 per week or not less than $27. 63 per hour. The law specifies that computer specialist’s primary duties involve applying systems analysis techniques and procedures. Designing, developing, documenting, analyzing, creating, testing, or modifying computer systems or programs, prototypes and/or machine operating systems. There are a number of employees that are exempt from only the overtime pay requirements.These include taxicab drivers, announcers, news editors, and chief engineers of radio and TV stations that have fewer than 100,000 people located in a town or city (Repa, 2007 and Steingold, 2 009). In 1963 an amendment called the â€Å"Equal Pay Act† had been added to equalize the pay scales for men and women who work at an equal skill, effort and responsibility. Congress felt that the differential in pay prevented the maximization of the available labor resources, they wanted to prevent labor disputes, and they did not want an unfair method of competition.They also felt that the wage differentials depressed the wages and the standard of living. Congress also wanted to eliminate stereotypes about the value of work performed by women. Congress exempted several forms of discrimination from the operation of the Equal Pay Act. These exceptions include shift differentials, restrictions on or differences based on the time of day worked, hours of work, and the lifting or moving of heavy objects. The Equal Pay Act also excluded differences based on experience, training or ability, as well as unusual or higher than normal wage rates which employers maintained for valid rea sons.The Equal Pay Act allows for unequal pay for equal work only when wages are set pursuant to a seniority system, a merit system, a system which measures earnings by quantity or quality of production, or other factors outside of sex (The Bureau of National Affairs, Inc, 1963 and Landsberg, 2004). In 2004 a class action suit was brought against Wal-Mart were 1. 6 million female associates that worked for Wal-Mart felt that they were discriminated against because they were women. These women tried to advance into higher paying positions but were passed over by men/boys who did not have the experience and knowledge that these women had.More than seventy percent of the Wal-Mart workforce is women, sixty-five percent of the cashier and greeter positions are held by women and only thirty-five percent of the assistant managers for Wal-Mart are women. The female employees of Wal-Mart are paid less than the male workforce for jobs that are of equal skill, effort and responsibility all for keeping prices lower for the consumer (Worth, 2008 p 8-12). The Fair Labor Standard Act requires employers to keep records of wages, hours, and other regulated items by the Department of Labor.Most of the information is generally obtained by employers in ordinary business practice and in compliance with other laws and regulations. Employees that are subject to the minimum wage provisions or both the minimum wage and overtime pay provisions must have employers keep the following records with personal information, including employee's name, home address, occupation, sex, and birth date if under 19 years of age, the hour and day when workweek begins and the total hours worked each workday and each workweek.These records also need to indicate the total daily or weekly straight-time earnings and the regular hourly pay rate for any week when overtime is worked and total overtime pay for the workweek. In addition to records for hours worked and paid the records also must include deduction s from or additions to wages, total wages paid each pay period and the date of payment and pay period covered. The Records required for exempt employees differ from those for nonexempt workers. Special information is required for employees that work from the home and for employees to where lodging is provided (http://www. ol. gov/dol/whd/regs/compliance/hrg. htm). The constitutionality of the â€Å"Fair Labor Standard Act† was unanimously supported by the Supreme Court it has been altered and amended on at least 43 occasions between 1938 and 2009. Those alterations and amendments have provided and clarified benefits to workers in various employment sections, and made increases to the minimum wage. As a hardworking American we have a right to be paid fairly for our work. It is unfortunate that many unscrupulous employers attempt to manipulate laws intended to protect workers in order to avoid paying just compensation.When this happens, employees can turn to the legal system to ensure that their rights are protected without being discriminated against or discharged for filing a complaint or participate in any proceeding under the Act. ? Negotiation and Compliance: An Article Analysis

Dick Olver, chairman of BAE Systems, writes an empirical analysis of negotiation and ethical compliance in the article â€Å"Ethical Business Cultures†. His approach is that of an expert in both observation and experience in the analysis of negotiation and the behavioral aspects of corporate culture. Every successful enterprise requires the strong foundations of leadership and the willingness of the rest to believe in the vision of the leader and to follow him or her. Olver understands this firsthand and believes that implementing change in the form of an ethical working environment is key to a company’s success and employee happiness, overall. Though he asserts that there is a chain of command in every business, ethics is one area where all members of a working team must work at equally. Therefore, though demonstrating the effective use of ethics begins at the top of an organization, it can only be sustained by all employees’ involvement in it’s continuation. Olver readily outlines the processes of both the means by which employees eagerly accept the ethical vision of the business leader and the constant need for management to reinforce ethical behavior. There are no apparent flaws in his reasoning, as his expertise in the business world serves as a seemingly credible source of both advice and information. Olver initially lists three ways in which managers can negotiate compliance with their employees. A manager must be aware of what is important and communicate this to employees faithfully. He or she, also must take responsibility for ethics â€Å"embedment† and not depend or delegate this upon others. Finally, Olver suggests that questions must be asked in order to gauge the current level of diversity and willingness to accept diversity within an organization if that company wishes to acquire global contracts. Olver also lists eight standards for leaders in an ethically and globally motivated environment. To annotate this extensive information, the most key aspects of his experience and advice will follow. Leaders must consciously implement and improve benchmarking, reporting, and transparency features of company goal achievement, as this helps to keep all employees and global partners abreast of current procedures. Similarly, laws and contracts must be upheld and protected, but not at the level that interactions within the company and with outside agencies would be so secret as to arouse suspicion. The key here is that transparency is of the utmost importance in gaining trust in employees, but that not everything can be completely transparent in any organization. Olver concludes his writing with an encouragement to all business leaders to help implement an ethical environment using his expertise and experience. His conclusions are that all business leaders must be strong and determined in practicing their negotiation skills with their employees. The fear of change is common in all business settings, therefore negotiating change within an organization must be the priority of the business leader. He or she must confront the fears of change and convince others to follow that new direction of fearlessness. Having the ability to lead and to instill trust and ethics in employees yields much satisfaction and takes great skill. This not only benefits the manager in their self-esteem in their ability to positively negotiate, but it helps employees to remain happy and productive while yielding great results for the company and the bottom line.

Critique on Mm Theory Essay

It does not matter what the firm’s dividend policy is (Modigliani and Miller 958). The basic assumptions of MM theory are: 1 . The company only has the long-term bonds and common stocks, both bonds and stock trade in the complete capital market with no transaction cost; 2. The individual investors and corporate investors could gain the same interest rate with no liability risk; 3. The companies with similar operating conditions have the same business risks; 4. Investors hold the same expectations on the average business profit in future; 5. All cash flows are perpetual annuities, including EBIT (Earnings before interest and tax) etc, that is, the growth ate of the enterprise is zero (Modigliani and Miller 1958). The development of MM theory mostly experienced three stages: 1 . No-tax model. The first MM model takes no account of corporate taxations; 2. Corporate tax model. Modigliani and Miller (1963) published Corporate Income Taxes and the Cost of Capital: A Correction, which loosened its initial assumptions, introduced corporate tax into MM theory(Modigliani and Miller 1963); 3. Miller model. Merton H. Miller (1976) proposed to consider corporate tax and individual tax in estimating how the debt leverage impacts the value of firm (Miller 1977). During the past 50-year, MM theory has made tremendous academic achievements for western companies in exploring the optimal capital structure and reducing capital costs etc. Firstly, it provides a research frame of reference and theoretical basis. Since that, most of the capital theories are base on MM theory, such as Pecking-order Theory, Trade-off Theory, and Agency Theory etc. Secondly, MM theory makes the capital structure theories systematic and builds a framework for the development of capital structure theories. Secondly, MM theory makes the capital tructure theory systematically, as there was not a system of traditional capital structure theory. Last, but not least, it is only a general description of the traditional capital structure theory. While MM theory uses modern analytical methods, such as partial equilibrium, mathematical analysis etc, therefore, it makes MM theory become reliable. Despite tremendous achievements, there are still limitations in MM theory. First, the assumptions are too harsh, and most of them cannot be achieved in reality. To illustrate, MM theory assumes that individuals and corporations could borrow at the ore than what corporations do, as well as bear a higher risk. Furthermore, MM theory also assumes there is no transaction cost, which extremely differs from the real transaction process. Second, the assumptions are beyond the reality, although the logic derivation is correct, the conclusions still differs. Both corporate tax model and Miller model suppose that corporation should raise the liability as much as possible in order to maximise the value of the firm, in extremity, up to 100% liability. However, none of enterprises adopt this point. Third, MM theory stands at a static erspective, and does not consider the external economic environment and the impact on capital structure by changing enterprise’s production and operating conditions. In fact, many factors, which affect the capital structures, are variable. For example, companies should cut down their liabilities appropriately in order to reduce business risks, when the socio-economic experiences a recession. According to MM theory, the value of tax saving is associated with the corporate income tax rate. That is, the higher corporate income tax rate, the more tax deductible the corporation could achieve from financing by liability. In other words, corporations are inclined to finance by liabilities rather than equity financing in relative higher corporate income tax rate countries, and vice versa. Under the actual situation in China, the corporate income tax is much higher than other countries in the world; corporations should prefer financing from debt theoretically (Huang and Zhang 2007). However, actually, the capital structure of Chinese enterprises runs counter to the MM theory and other capital structure theories. The proportion of liability financing in China is far less than the proportion of equity financing (Huang and Song 2006). First of all, there is merely no mechanism in applying MM theory. In accordance with the MM theory, both individual and institutional investors can process arbitrage actions freely in the capital markets. In western well-developed capital markets, there is a wide range of fund-raising channels and other financing options, the arbitrage mechanisms usually affect the markets. However, at present, the market mechanism is not fully developed in China, as well as capital market is under-developed. Thus, these limit the financing options and forms; make it difficult to carry out arbitrage activities. Generally, MM theory cannot be applied.
